1 Innledning

Vi i foreningen KVANN (“vi”) er opptatt av at du skal ha tillit til oss og hvordan vi behandler dine personopplysninger. I denne personvernerklæringen forklarer vi derfor hvorfor vi samler inn informasjon om deg, hvordan vi bruker denne informasjonen og hvordan vi tar hensyn til ditt personvern.

Personopplysninger er opplysninger og vurderinger som kan knyttes til en identifiserbar enkeltperson. Dette kan for eksempel være navn og kontaktinformasjon, kjøpshistorikk eller informasjon om interesser.

Bruk av personopplysninger må følge personopplysningsloven. Vi, som behandlingsansvarlig, vil sørge for at vi bruker personopplysninger om deg i samsvar med lovens regler.

2 Hvilke personopplysninger har vi om deg

Avhengig av hvilken informasjon du gir oss, hvordan du bruker våre tjenester, og hvilke tillatelser du gir oss, har vi disse opplysningene om deg:

Personalia: Informasjon du oppgir når du oppretter en brukerkonto eller bestiller medlemskap eller produkter/tjenester, som navn, adresse, telefonnummer og e-postadresse. Du kan velge å gi oss mer informasjon om deg selv, som kjønn og fødselsdato.
Kjøpsinformasjon: Informasjon vi får når du handler i vår nettbutikk, som hva du har kjøpt, kortnummer og betalingsmetode (f.eks. Visa). Om du har brukerkonto hos oss vil du få oversikt over dine tidligere kjøp i din brukerkonto.
Kommunikasjon: Informasjon du gir oss når du har kontakt med oss, som eposter sendt mellom oss.
Opplysninger om bruk på nettsidene: Informasjon vi får når du bruker vår nettside og app, som hva slags enhet du har (f.eks. mobil eller PC), IP-adresse, hvilke sider du besøker og hvilke funksjoner du bruker der.
Opplysninger fra partnere: Informasjon vi får fra våre samarbeidspartnere.
Profileringsopplysninger: Informasjon og antakelser vi lager automatisk basert på de andre opplysningene (nevnt ovenfor) vi har om deg, som dine preferanser og interesser og hvilke demografiske grupper du tilhører, og som informasjon om bosted og dyrkingsmulighter, med mindre du har motsatt deg dette.

3 Hva bruker vi personopplysningene til

Vi bruker personopplysningene dine til følgende formål:

Tilby nettside og app: Vi kan bruke opplysninger for å tilpasse vår nettside og evt app til det tekniske utstyret du bruker. Vi kan også bruke opplysningene til å tilpasse innholdet på vår nettside og evt app til hva vi tror du er interessert i.
Gjennomføre bestillinger i nettbutikken: Vi bruker opplysninger for å gjennomføre dine kjøp, bl.a. for å sende deg varer, motta betaling og lagre kjøpshistorikk
Tilgang til å bestille plantemateriale gjennom plantedatabasen: Vi bruker opplysninger for å gjennomføre dine bestillinger, det vil si å motta bestilling, dele ditt telefonnummer, din epostadresse og din leveringsadresse med donor/medlemmet du bestilte plantemateriale fra, registrering av mottatt materiale, din fremtidige registrering av egen dyrkning av plantematerialet.
Opprette brukerkonto: Vi bruker opplysninger dersom du oppretter brukerkonto, bl.a. for å gi deg tilgang med brukernavn og passord, for å lagre din kontaktinformasjon og betalingsinformasjon, og for at du kan se din kjøpshistorikk.
Kundeservice: Vi lagrer opplysninger som du gir og mottar dersom du har kontakt med oss for å yte service og administrere ditt medlems-/kundeforhold.
Statistikk: Vi utarbeider statistikk for å forbedre og videreutvikle våre produkter og tjenester. Så langt det er mulig gjør vi dette med anonyme opplysninger, uten at vi vet at informasjonen er knyttet spesifikt til deg.
Markedsføring: Vi bruker din kontaktinformasjon (f.eks. telefonnummer og epostadresse) til å sende deg anbefalinger og informasjon om våre tilbud. Vi kan bruke profileringsopplysninger for å gjøre anbefalingene og informasjonen mest mulig relevant for deg, med mindre du har motsatt deg dette. Hvis du ønsker det, vil vi også sende deg anbefalinger og informasjon om våre samarbeidspartneres tilbud.

Det rettslige grunnlaget for formål 1, 5 og 6 er vår berettigede interesse i å kunne tilby, videreutvikle og markedsføre våre tjenester.

Det rettslige grunnlaget for formål 2, 3, 4 og 5 er for å oppfylle vår kontrakt med deg.

Det rettslige grunnlaget for formål 6 kan også være ditt samtykke, dersom du har gitt oss dette. Det kan være nødvendig for å sende deg markedsføring dersom du ikke lenger har brukerkonto hos oss, eller dersom vi sender deg henvendelser om våre samarbeidspartneres arbeide.

4 Hvem deler vi personopplysninger med

Vi kan komme til å dele personopplysninger med selskaper som leverer tekniske og administrative tjenester til oss, slik som IT-leverandører, men vil begrense dette så mye som mulig, og har uansett avtaler med disse for å sikre ditt personvern.

Vi kan utlevere opplysninger i enkelttilfeller, eksempelvis til offentlige myndigheter, ved mistanke om lovbrudd.
Hvis du samtykker, kan vi dele dine personopplysninger med våre samarbeidspartnere som beskrevet i ditt samtykke. Dette kan f.eks. være offentlige tjenesteytere, som Norsk genressurssenter, slik at de kan sende deg anbefalinger og informasjon som er relevante for deg, eller slik at de kan foreta egne markedsanalyser og tjenesteutvikling.

Vi benytter oss av IT-leverandører utenfor EØS. Hvis vi overfører personopplysninger ut av EØS, sørger vi for å sikre personvernet gjennom inngåelse av kontrakter. Du kan be om mer informasjon eller en kopi av sikkerhetsmekanismene vi bruker for å sikre overføringen av opplysningene.
Vi kan for øvrig dele anonymiserte opplysninger med samarbeidspartnere for bl.a. markedsanalyser og tjenesteutvikling.

5 Hvor lenge lagrer vi personopplysninger

Vi lagrer opplysninger om deg, kun så lenge det er nødvendig for å oppnå formålet de ble innhentet for, eller dersom vi er pålagt å lagre opplysningene. Opplysningene vil slettes eller anonymiseres når de ikke lengre er nødvendige for å oppnå formålet. Under er en oversikt over hvor lenge vi lagrer dine opplysninger:

Opplysninger om deg: Hvis du har brukerkonto hos oss, sletter vi opplysningene når du sier opp brukerkontoen eller hvis du har vært inaktiv i over 12 måneder. Hvis du ikke har brukerkonto hos oss, sletter vi opplysningene tre måneder etter siste interaksjon fant sted med mindre du ber oss om å lagre opplysninger til neste kjøp.
Kjøpsinformasjon: Hvis du har brukerkonto hos oss, lagrer vi kjøpshistorikken din (oversikt over hvilke medlemskap og andre produkter eller tjenester du har kjøpt) i 12 måneder i din brukerprofil. Vi sletter kortnummeret ditt tre måneder etter at siste interaksjon fant sted, med mindre du ber oss om å lagre opplysningene til neste kjøp. Vi lagrer transaksjoner og betalingsinformasjon i 5 år i henhold til bokføringsloven.
Opplysninger om bruk på nettsidene: Vi lagrer informasjon om din bruk av våre nettsider i opptil 6 måneder.
Opplysninger fra partnere: Vi lagrer eventuell informasjon fra samarbeidspartnere så lenge du har en aktiv brukerkonto hos oss eller så lenge du har samtykket. Vi vil slette opplysningene dersom du sier opp brukerkontoen eller brukerkontoen har vært inaktiv i 12 måneder.
Kommunikasjon: Vi lagrer kommunikasjon med våre kunder i tre år, med mindre vi trenger å lagre det lenger, f.eks. i forbindelse med klager eller krav.
Profileringsopplysninger: Hvis du har brukerkonto hos oss, sletter vi opplysningene når du sier opp brukerkontoen eller brukerkontoen har vært inaktiv i over 12 måneder. Vi vil slette opplysningene tidligere hvis du motsetter deg å bli profilert.

6 Dine rettigheter

Du kan ha rett til å be oss å:

Gi deg ytterligere informasjon om hvordan vi behandler dine personopplysninger
Gi deg en kopi av personopplysninger om deg
Oppdatere dine personopplysninger
Slette opplysninger som vi ikke lengre har grunnlag til å oppbevare
Begrense eller stoppe behandlingen av dine opplysninger
Motsette deg automatiske individuelle avgjørelser, inkludert profilering
Gi deg opplysninger du har gitt til oss i en strukturert, alminnelig anvendt og maskinlesbart format eller, der det er teknisk mulig, be oss om å overføre disse til en annen virksomhet
Trekke tilbake eventuelle samtykker du har gitt oss

Vær klar over at det finnes begrensninger i disse rettighetene. Ta gjerne kontakt med oss hvis du vil ha mer informasjon om dette.

Hvis du mener at vi behandler personopplysninger i strid med personopplysningsloven, har du rett til å klage til Datatilsynet. Før du eventuelt gjør dette, vil vi gjerne at du kontakter oss slik at vi kan besvare dine spørsmål eller oppklare eventuelle misforståelser.

7 Nettstedskapsler

Vi kan bruke nettstedskapsler på våre nettsider for å sikre funksjonalitet på nettsiden, analysere nettrafikk og se hvilke områder på vårt nettsted du har besøkt. Vennligst les våre retningslinjer for bruk av nettstedskapsler for mer informasjon.

8 Endringer i personvernerklæringen

Vi vil kunne oppdatere personvernerklæringen fra tid til annen. Du vil få beskjed om endringer av betydning. Du vil alltid finne siste versjon av vår personvernerklæring på nettsiden/appen.

1 Introduction

KVANN (“we”) is committed to make sure that you can trust us and how we process your personal information. In this privacy statement, we explain why we collect information about you, how we use this information, and how we take account of your privacy.

Personal information is information and assessments that can be linked to an identifiable individual. This can be, for example, your name and contact information, purchase history or information about your interests.

Use of personal data must comply with the Norwegian Personal Data Act. We, as the controller, will ensure that we use your personal information in accordance with the law.

2 What personal information do we have about you?

Depending on what information you provide us, how you use our services, and what permissions you give us, we have the following information about you:

Personalia: Information you provide when you create a user account or order membership or products / services, such as your name, address, phone number and email address. You can choose to give us more information about yourself, such as gender and date of birth.
Purchase information: Information we get when you shop in our online store, such as what you bought, card number and payment method (e.g.. Visa). If you have a user account with us you will get an overview of your previous purchases in your user account.
Communication: Information you give us when you contact us, such as emails sent between us.
Website Usage Information: Information we get when you use our website and app, such as what kind of device you have (such as mobile or PC), IP address, which pages you visit and what features you use there.
Partner information: Information we get from our partners.
Profiling Information: Information and assumptions we automatically create based on the other information (mentioned above) we have about you, as your preferences and interests and what demographic groups you belong to, and information about residence and cultivation opportunities, unless you have contradicted this.

3 What we use personal information for

We use your personal information for the following purposes:

Offer Website and App: We may use information to customize our website and any app to the technical equipment you use. We may also use the information to personalize the content of our website and any app to what we think you are interested in.
Place orders: We use information to complete your purchases, including: to send you goods, receive payment and store purchase history
Creating a user account: We use information if you create a user account, e.g.. to provide you with username and password, to store your contact information and payment information, and to view your purchase history.
Customer Service: We store information that you provide and receive if you contact us to provide service and manage your membership / customer relationship.
Statistics: We compile statistics to improve and further develop our products and services. As far as possible, we do this with anonymous information, without our knowledge that the information is specifically related to you.
Marketing: We use your contact information (e.g.. phone number and email address) to send you recommendations and information about our offers. We may use profiling information to make the recommendations and information most relevant to you, unless you have contradicted this. If you wish, we will also send you recommendations and information on the offerings of our partners.

The legal basis for 1, 4 and 5 above is our legitimate interest in being able to offer, develop and market our services. The legal basis for 2, 3 and 4 is to fulfil our contract with you.

The legal basis for point 5 may also be your consent, if you have given us this. It may be necessary to send you marketing if you no longer have a user account with us, or if we send you inquiries about the work of our partners.

4 Who we share personal information with

We may share personal information with companies that provide technical and administrative services to us, such as IT providers, but will limit this as much as possible and have agreements with them to ensure your privacy.

We may disclose information in individual cases, for example to public authorities, on suspicion of a criminal offense.

If you consent, we may share your personal information with our affiliates as described in your consent. This can be done, for example. be public service providers, such as the Norwegian Genetic Resource Centre, so that they can send you recommendations and information that are relevant to you, or in order that they can conduct their own market research and service development.

We use IT suppliers outside the EEA. If we transfer personal data out of the EEA, we ensure the privacy through the conclusion of contracts. You can request more information or a copy of the security mechanisms we use to secure the transmission of the information. We can also share anonymous information with partners for, amongst other things. market analysis and service development.

5 How long we store personal data

We store information about you only as long as it is necessary to achieve the purpose for which it was obtained, or if we are required to store the information. The information will be deleted or anonymized when it is no longer necessary for the purpose. Below is an overview of how long we store your information:

Information about you: If you have a user account with us, we will delete the information when you cancel your user account or if you have been inactive for over 12 months. If you do not have a user account with us, we will delete the information three months after the last interaction occurred unless you ask us to store information for your next purchase.
Purchase information: If you have a user account with us, we will store your purchase history (overview of which membership and other products or services you have purchased) for 12 months in your user profile. We will delete your card number three months after the last interaction occurred, unless you ask us to store the information for your next purchase. We store transactions and payment information for 5 years in accordance with the Accounting Act.
Website Usage Information: We store information about your use of our website for up to 6 months.
Partner Information: We store any affiliate information as long as you have an active user account with us or as long as you consent. We will delete the information if you cancel your user account or user account has been inactive for 12 months.
Communication: We store communication with our customers for three years, unless we need to store it longer, e.g. in connection with complaints or claims.
Profiling information: If you have a user account with us, we will delete the information when you terminate your user account or the user account has been inactive for over 12 months. We will delete the information earlier if you oppose being profiled.

6 Your rights

You may have the right to ask us to:

Provide you with additional information on how we process your personal information
Provide you with a copy of personal information about you
Update your personal information
Delete information that we no longer have grounds to store
Restrict or stop the processing of your information
Oppose automatic individual decisions, including profiling
Provide you with information you have provided to us in a structured, commonly used and machine-readable format or, where technically feasible, ask us to transfer these to another company
Withdraw any consent you have given us

Please be aware that there are limitations to these rights. Feel free to contact us for more information on this.

If you believe that we process personal data in violation of the Personal Data Act, you have the right to appeal to the Data Inspectorate. Before you do this, we would like you to contact us so that we can answer your questions or resolve any misunderstandings.
